1. Acceptance of Terms & Parties

These Terms of Service ("Terms") constitute a legally binding agreement between InstaSnapic ("Platform", "we", "us", or "our") and the photography studios, photographers, and authorized business entities ("Studio", "Photographer", or "You") accessing or utilizing our services. These terms also govern the access of event attendees and visitors ("Guests") accessing public galleries via QR codes or direct links.

By registering an account, creating an event, uploading photographs, or scanning a gallery QR code, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately refrain from accessing the Platform.

2. Technology Intermediary Status (Section 79 IT Act)

InstaSnapic operates strictly as a cloud-based technology platform and software-as-a-service ("SaaS") provider. In accordance with Section 2(1)(w) and Section 79 of the Indian Information Technology Act, 2000:

• InstaSnapic is an Intermediary that provides cloud storage pipelines, image delivery, and automated computer-vision indexing.
• InstaSnapic does not initiate the transmission, select the receiver of the transmission, or select or modify the photographs contained in the transmission.
• The Studio is the sole Content Publisher and primary Data Fiduciary determining which photos are captured and uploaded.

3. Strict Live-Day Upload Lock Policy

To ensure fair usage, prevent server storage abuse, and preserve event integrity, InstaSnapic enforces an automated, non-negotiable Hard Bound Live-Day Upload Rule:

4. 48-Hour Guest Viewing Window & Auto-Expiry

Guest access via QR code standees and personal photo delivery galleries is time-bound:

• The QR code, public gallery, and personal face-matching engine remain active for exactly 48 hours from the start of the scheduled event date (00:00 local time).
• Once the 48-hour window expires, all guest access is automatically terminated. Any guest scanning the QR code will receive the notice:“This live gallery view window has expired. Photos are accessible via QR code for 48 hours from the event date.”
• Guests are strongly advised to download their matched photographs during the 48-hour window. InstaSnapic is under no obligation to maintain permanent cloud hosting for expired galleries.

5. Studio Legal Obligations & Indemnification

By creating an event and uploading media, the Studio expressly warrants and covenants that:

• Consent to Photograph: You have been formally commissioned by the event hosts and possess all legal rights, licenses, and permissions to photograph the attendees at the venue.
• Attendee Notice: You have prominently notified event guests (e.g., via event signage, invitations, or announcements) that photography is underway and that AI face-matching will be offered for photo delivery.
• DPDP Act & Privacy Compliance: You comply with all applicable privacy laws, including the Digital Personal Data Protection Act, 2023 (India).
• Comprehensive Legal Indemnity: You agree to fully indemnify, defend, and hold harmless InstaSnapic, its founders, directors, employees, and infrastructure partners against any and all third-party claims, lawsuits, regulatory penalties, legal fees, or damages arising from: (a) infringement of intellectual property rights; (b) unauthorized photography; (c) privacy or biometric complaints by guests; or (d) any breach of these Terms.

6. AI Biometric Face Recognition & Accuracy

InstaSnapic utilizes Amazon Rekognition (Asia Pacific - Mumbai) to extract mathematical vector embeddings from uploaded photographs and guest selfies.

• Purpose Limitation: Biometric embeddings are strictly used to perform 1:N matching within the isolated face collection of the scanned event.
• No Public AI Training: Biometric data is never used to train public machine learning models, sold, rented, or cross-matched across unrelated studios or events.
• Probabilistic Nature: Computer-vision face matching depends on lighting, facial orientation, resolution, sunglasses, masks, and occlusions. InstaSnapic makes no guarantee of 100% facial detection or match accuracy. Occasional misses or false matches do not constitute a defect in service.

7. Prohibited Content & Takedown Policy

In compliance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines) Rules, 2021, users shall not host, upload, or share content that:

• Is obscene, pornographic, paedophilic, or invasive of another's privacy.
• Contains Child Sexual Abuse Material (CSAM) — zero tolerance; reported immediately to law enforcement.
• Infringes any patent, trademark, copyright, or other proprietary rights.
• Threatens the unity, integrity, defense, security, or sovereignty of India.
• Contains software viruses or malicious code.

InstaSnapic reserves the right to immediately remove offending content and permanently terminate violating accounts without prior notice or refund.

8. Fees, Wallet Charges & Refund Policy

• Event Base Fee: Creating an event requires a non-refundable base fee of ₹499, which includes provisioned storage and AI indexing for the first 1,000 photographs.
• Dynamic Slab Billing: Beyond 1,000 photos, each additional block of 200 photos is charged at ₹50, automatically deducted from the Studio's prepaid wallet balance upon crossing slab thresholds (1001, 1201, 1401, etc.).
• Non-Refundable Policy: Once an event date commences or photographs have been indexed, event fees and slab consumption charges are strictly non-refundable. Wallet top-ups are non-transferable and cannot be refunded to bank accounts once credited.

9. Intellectual Property & Branding Watermark

All rights, title, and copyright in the original event photographs remain with the Studio or respective copyright holders. The Studio grants InstaSnapic a worldwide, royalty-free, temporary license to store, resize, process, and display photos solely to operate the gallery service.

Guest downloads automatically include a digital watermark badge containing the Studio's verified logo and contact number to protect photographer attribution and promote the Studio's brand.

10. Limitation of Liability & Disclaimers

The platform is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law, InstaSnapic disclaims all warranties, express or implied. We are not liable for:

• AWS cloud outages, telecommunication failures, or poor internet at event venues.
• Inability to upload photos after midnight due to the strict live-day upload lock.
• Any indirect, incidental, punitive, or consequential damages.
• Our maximum aggregate liability under any circumstances shall not exceed the total fees paid by the Studio for the specific event giving rise to the claim.

11. Governing Law & Statutory Grievance Officer

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in India.
